Can I compare offers or switch Delegated Party?
Yes, the market is open: compare net €/kWh, the payment milestone and what happens if the case file does not go through. Switching SD is only possible before signing the agreement (or by terminating it under its clauses); the same saving cannot be ceded twice.
I signed the cession but haven't been paid — what do I do?
The agreement is a private contract: make a written claim to the counterparty and, if they do not respond, through the civil courts. The regulations require the consideration to be certain and traceable, which works in your favour. If you suspect irregularities by the SD, you can bring them to the attention of the National Coordinator.
The installer didn't inform me and time has passed — am I still in time?
Possibly yes: there is a window of up to 3 years from the action to register the CAE (if execution started after 26/01/2023). The sooner it is processed, the more commercial useful life the certificate retains.
How do I know if the company offering it to me is legitimate?
Check that it is (or works with) a Delegated Party accredited in MITECO's official list, that the agreement sets out the certain consideration in €/kWh, and be wary of anyone asking for upfront payments to "process" the CAE for you.
Can I withdraw from the agreement after signing it?
It depends on the clauses of the agreement itself (private law) and, where applicable, the consumer regulations applicable to contracts with consumers (e.g. withdrawal in distance contracting). If the savings have already been certified, the cession is complete.
What penalties are there for falsifying data or duplicating savings?
In addition to the refusal of registration or loss of effectiveness of the CAE, the SNOEE penalty regime applies (Ley 18/2014, arts. 79-81), with infringements that can be very serious, and any civil or criminal liabilities arising from documentary falsification.
